Terms of Service

These Terms of Service ("Terms") govern your use of WinsProposal, an AI-powered proposal generation service operated by Polsia Inc. ("we", "us", "our") at winsproposal.com.

By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

WinsProposal provides AI-assisted proposal generation for businesses responding to Requests for Proposals (RFPs). The service includes:

RFP analysis and parsing
AI-generated proposal content across industry-specific templates
Competitive analysis and win probability scoring
Knowledge base for storing company context
Proposal refinement and iteration

2. Eligibility

You must be at least 16 years old to use WinsProposal. By using the service, you represent that you have the legal capacity to enter into these Terms.

3. Account Registration

You must provide a valid email address and create a password
You are responsible for maintaining the confidentiality of your login credentials
You are responsible for all activities that occur under your account
Notify us immediately if you suspect unauthorised access to your account

4. Your Content

You retain ownership of all content you upload to WinsProposal, including RFP text, knowledge base entries, and company information.

You also own the AI-generated proposals created using your inputs. You may use, modify, and distribute the generated proposals for any business purpose.

By uploading content, you grant us a limited licence to process it through our AI systems solely for the purpose of providing the service. We do not:

Use your content to train AI models
Share your content with other users
Sell or licence your content to third parties

5. Acceptable Use

You agree not to:

Use the service for any unlawful purpose
Upload content that infringes intellectual property rights
Attempt to reverse engineer, decompile, or hack the service
Use automated tools to scrape or bulk-access the service beyond normal API usage
Impersonate another person or entity
Upload malicious content or files

6. Subscription Plans & Billing

Free Tier

2 proposals per day, no credit card required
Access to all industry templates and basic features

Paid Plans

Pro: $20/month (or ₹1,660/month) — 10 proposals/day, 100/month
Business: $49/month (or ₹4,080/month) — 25 proposals/day, 500/month

Billing Terms

Payments are processed by Stripe (USD) or Razorpay (INR)
Subscriptions renew automatically unless cancelled
You may cancel at any time; access continues until the end of the billing period
Refunds are handled on a case-by-case basis — contact us within 7 days of purchase

7. AI-Generated Content Disclaimer

AI-generated proposals are a starting point, not a final product. You should:

Review and verify all generated content before submission
Check factual claims, pricing calculations, and compliance statements
Customise the proposal with your actual company details, past performance, and capabilities
Have qualified personnel review proposals before submission to clients

We do not guarantee that proposals will win contracts or be accurate for all use cases. AI-generated content may contain errors, hallucinations, or outdated information.

8. Intellectual Property

The WinsProposal service, including its design, code, templates, and branding, is owned by Polsia Inc. and protected by intellectual property laws.

Your licence to use the service is non-exclusive, non-transferable, and revocable.

9. Data Protection

We process personal data in accordance with our Privacy Policy, which complies with UK GDPR, EU GDPR, and India's DPDPA.

Key points:

You can export all your data at any time (JSON format)
You can delete your account and all data at any time
We do not sell personal data
Analytics tracking requires your explicit consent

10. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may:

Perform scheduled maintenance (with advance notice where possible)
Experience downtime due to third-party service issues
Modify, suspend, or discontinue features with reasonable notice

11. Limitation of Liability

To the maximum extent permitted by law:

WinsProposal is provided "as is" without warranties of any kind
We are not liable for any indirect, incidental, special, or consequential damages
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
We are not responsible for the outcome of proposals submitted using our service

Nothing in these Terms excludes liability for: death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold harmless WinsProposal and Polsia Inc. from claims arising from your use of the service, your content, or violation of these Terms.

13. Termination

You may close your account at any time via the app or by contacting us
We may suspend or terminate accounts that violate these Terms
Upon termination, your data will be deleted in accordance with our Privacy Policy

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. For users in India, the provisions of Indian consumer protection law also apply where mandatory.

Any disputes shall be resolved through the courts of England and Wales, except where local law requires otherwise.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 30 days before they take effect. Continued use after changes constitutes acceptance.
